In an article in this journal, Christopher Cowley argues that we have ‘misunderstood the special nature of medicine, and have misunderstood the motivations of the conscientious objectors’. We have not. It is Cowley who has misunderstood the role of personal values in the profession of medicine. We argue that there should be better protections for patients from doctors' personal values and there should be more severe restrictions on the right to conscientious objection, particularly in relation to assisted dying. We argue (...) that eligible patients could be guaranteed access to medical services that are subject to conscientious objections by: removing a right to conscientious objection; selecting candidates into relevant medical specialities or general practice who do not have objections; demonopolizing the provision of these services away from the medical profession. In this paper, we investigate how data about public preferences may be used to inform policy around the use of controversial novel technologies, using public preferences about autonomous vehicles (AVs) as a case study. We first summarize the recent ‘Moral Machine’ study, which generated preference data from millions of people regarding how they think AVs should respond to emergency situations. We argue that while such preferences cannot be used to directly inform policy, they should not be disregarded. We defend an (...) approach that we call ‘Collective Reflective Equilibrium in Practice’ (CREP). In CREP, data on public attitudes function as an input into a deliberative process that looks for coherence between attitudes, behaviours and competing ethical principles. We argue that in cases of reasonable moral disagreement, data on public attitudes should play a much greater role in shaping policies than in areas of ethical consensus. We apply CREP to some of the global preferences about AVs uncovered by the Moral Machines study. We intend this discussion both as a substantive contribution to the debate about the programming of ethical AVs, and as an illustration of how CREP works. We argue that CREP provides a principled way of using some public preferences as an input for policy, while justifiably disregarding others. (shrink)

A crucially important part of the biosphere – the virosphere – is too often overlooked. Inclusion of the virosphere into the global picture of protein structure space reveals that 63 protein domain superfamilies in viruses do not have any structural and evolutionary relatives in modern cellular organisms. More than half of these have functions which are not virus‐specific and thus might be a source of new folds and functions for cellular life. The number of viruses on the planet exceeds that (...) of cells by an order of magnitude and viruses evolve up to six orders of magnitude faster. As a result, cellular species are subject to a constitutive ‘flow‐through’ of new viral genetic material. Due to this and the relaxed evolutionary constraints in viruses, the transfer of domains between host‐to‐virus could be a mechanism for accelerated protein evolution. The virosphere could be an engine for the genesis of protein structures, and may even have been so before the last universal common ancestor of cellular life. (shrink)

I contrast Robert Veatch's recent liberal vision of medical decision‐making with a more rationalist liberal model. According to Veatch, physicians are biased in their determination of what is in their patient's overall interests in favour of their medical interests. Because of the extent of this bias, we should abandon the practice of physicians offering what they guess to be the best treatment option. Patients should buddy up with physicians who share the same values —‘deep value pairing’. The goal of choice (...) is maximal promotion of patient values. I argue that if subjectivism about value and valuing is true, this move is plausible. However, if objectivism about value is true — that there really are states which are good for people regardless of whether they desire to be in them — then we should accept a more rationalist liberal alternative. According to this alternative, what is required to decide which course is best is rational dialogue between physicians and patients, both about the patient's circumstances and her values, and not the seeking out of people, physicians or others, who share the same values. Rational discussion requires that physicians be reasonable and empathic. I describe one possible account of a reasonable physician. (shrink)

Robert Musil 1René Descartes's attempt to explain Eucharistic transubstantiation has long been understood as a dramatically significant moment in his tightrope walk across the medieval-to-modern divide. 2 Modeled (...) on the Last Supper in the New Testament, the Eucharistic rite had been explained in the Catholic tradition after the twelfth century in the scholastic philosophical language of substance and accident. 3 As the Council of Trent reaffirmed in 1551, this transubstantiation was a conversion "of the whole substance of the bread into the substance of the Body and of the whole substance of the wine into the substance of His blood... the appearances [speciebus] only of the bread and wine remaining." 4 Christ was [End Page 121] held to be "truly, really, and substantially contained under the species of those sensible things," under what still appeared to be bread and wine. 5Descartes's dilemma was that on one hand he was dead set against the hylomorphic theory of substance and accident, and on the other hand he found himself obliged by some of his interlocutors to comment on transubstantiation. It was a balancing act that pleased no one for very long, since despite his sometimes eager discussions of the Eucharist, he was not, as he admitted, "a theologian by profession." 6 The putative heterodoxy of Cartesian transubstantiation was principally responsible for his works being placed on the Index of Prohibited Books in 1663 and for his thought being banned from schools under Louis XIV in 1671. 7 His treatment of the Eucharistic question also distressed others in the seventeenth and early eighteenth centuries, such as Thomas Hobbes and Isaac Newton, who were unhappy that Descartes had bothered with such a theological non-issue. 8 For the many post-seventeenth-century advocates of a proto-secular Descartes as the godfather of modern philosophy, Cartesian transubstantiation has proved similarly inconvenient.The indisputable connections between Descartes and his scholastic forerunners, exemplified by the Eucharistic question, service a basic question of contemporary Cartesian scholarship. As Émile Boutroux put it, how was new wine poured from old bottles? 9 Accepting as axiomatic that there was something both radical and original in the Cartesian project but without falling back on pieties about his turn toward the modern subject, we must ask how Descartes put forth novel claims in conceptual language regarded by his contemporaries as resonant, if not consonant, with the scholastic intellectual culture of Catholic Reform France. More precisely, setting aside the not-very-defensible position that such language was merely incidental to Cartesian thought (a position that dehistoricizes Descartes as a precocious Enlightener), the dilemma then becomes explaining how original positions were elaborated within scholastic language. One important task is accounting for what Descartes did with that vocabulary--how he pointed words and concepts in new and surprising directions. The Eucharist becomes crucial in this perspective. My argument is that Descartes used one particular scholastic term, "mode," in equivocal ways and that this equivocation was in multiple senses rhetorical. This rhetoric coalesced and came to the fore around the Eucharist because, given the intellectual-political climate of the Catholic Reformation, the stakes of transubstantiation were so high. That Descartes used certain scholastic terms in equivocal or ambiguous ways should come as no surprise. Of interest, though, is the fact that by definition "mode" meant many things. This paper is a review and critical discussion of John Broome’s Rationality Through Reasoning. In particular, it engages critically with Broome’s view on the independence of normative reasons and rationality, his construal of the capacity, property, and requirement senses of “rationality”, and his account of reasoning as a conscious, rule-following operation on mental contents.

This paper examines Patrick Suppes’ probabilistic theory of causality understood as a theory of causal inference, and draws some lessons for empirical economics and contemporary debates in the foundations of econometrics. It argues that a standard method of empirical economics, multiple regression, is inadequate for most but the simplest applications, that the Bayes’ nets approach, which can be understood as a generalisation of Suppes’ theory, constitutes a considerable improvement but is still subject to important limitations, and that the currently fashionable (...) ‘design-based approach’ suffers from the same flaws Suppes anticipated a long time ago. It then sketches an alternative in response, one that differs drastically from the formalisms Suppes endorsed but is consistent with his pragmatic general take on science. (shrink)

In this article I argue that G.A. Cohen is mistaken in his belief that the concept of justice needs to be rescued from constructivist theorists of justice. In doing so, I rely on insights of John Rawls’ later work Political Liberalism and Rainer Forst’s discourse theory of justice. Such critical engagement with Cohen’s critique of constructivism is needed, because Cohen bases his critique of constructivism almost exclusively on Rawls’s arguments and positions in A Theory of Justice. He thus neglects - (...) at least by and large - that Rawls had further developed his constructivist method of justification in his later work Political Liberalism, as well as that Forst’s discourse-theoretical works offer elaborate versions of constructivism. These refined versions of constructivism recognize a plurality of reasonable conceptions of ideal justice and draw an important distinction between moral and political constructivism. Because of these features these advanced constructivist theories are not in need of Cohen’s rescue. (shrink)

Persistent disagreement is perhaps one of the defining features of modern liberal democracy. Disagreement, though, is not merely a philosophical nuisance, but a source of friction and conflict. The goal of this work is to inquire, whether we can conceive of a political order that might be judged superior to our current modus vivendi arrangements for settling conflict from a diverse set of normative standards or perspectives. In this essay we develop the concept of Polycentric Democracy.

This paper explores the connection between Kant’s first antinomy and the set-theoretical paradox of the largest cardinal. The lesson to be drawn is that we should refrain from reifying the collections that generate the antinomies: the collection of all spatio-temporal objects in the case of Kant’s first antinomy, the collection of all objects whatsoever in the case of the Cantorian paradox. This conclusion is not only one that we are entitled to draw but also one that does not generate new (...) philosophical problems of its own. El objetivo del presente trabajo es identificar el uso político de la imagen al servicio del Estado y la función del régimen democrático al interior del sistema filosófico de Thomas Hobbes. Tal propósito se aborda en dos momentos: I. se propone un análisis iconográfico, con lo cual se destaca una lógica de la presencia/ausencia de la multitud como un cuerpo político (i.e. problema de la dispersión); II. se retoman las discusiones en torno a la función de la democracia, y se (...) expone el problema de la dispersión como el paso de la multitud disuelta al pueblo junto a la consolidación del cuerpo soberano (i.e. régimen democrático). Se concluye que el uso político de la imagen, descrita a partir de la distinción entre la adoración civil y la adoración divina, por parte del poder soberano, es una exhortación hobbesiana a la regulación del miedo (ciu bono del sostenimiento del poder soberano). 2007 will be remembered as the year in which the Tour de France died. Race leader and likely eventual winner, Michael Rasmussen, was eliminated near the end on an allegation of doping. Since the 1960s, the idealistic drug crusaders have been on a mission to reverse the course of history, and eliminate drugs from the sport. But this “zero tolerance” strategy to drugs has failed, as 2007's Tour spectacularly showed. Only around 10–15% of professional athletes are drug tested. Currently, it (...) is illegal to use erythropoietin (EPO) or blood doping to move your haematocrit from 48 to 49% even though some people will have a normal level of 49%. A regulated permissive policy would paradoxically reduce risk to athletes. The present system creates an environment of risk to the athlete. A rational policy on doping would allow safe performance‐enhancing interventions which are consistent with the spirit of a particular sport. (shrink)

Les deux emporia dont il est question sont (...) des places de commerce situées à l'intérieur du pays thrace, contrôlées et financièrement exploitées par le roi. La cité de Pistiros joue un rôle d'intermédiaire entre le roi, d'un côté, et de l'autre côté, les emporia de l'intérieur, la cité de Maronée et les marchands de Thasos et d'Apollonia résidant à Pistiros. À la lumière d'autres informations sur le royaume des Odryses, il semble bien que non seulement Kotys, mais aussi un de ses trois successeurs, Amatokos (II), exerçait son pouvoir à la fois sur la vallée de la Haute Marica et sur la côte égéenne.
